1. Agreement to Terms

By accessing or using chickenspeaks (the "Service"), provided under the brand Black and Gold Feather Lab ("bgfeatherlab", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Pro Subscription & Billing

We offer a Premium subscription tier ("Pro Plan") priced at $9.99 per month. All subscription billing, processing, and checkout services are handled securely through our third-party merchant of record, Lemon Squeezy.

Subscription renewals are billed automatically on a recurring monthly cycle unless cancelled. You may cancel your subscription at any time through the billing dashboard link provided in your purchase confirmation email or Lemon Squeezy portal.

3. Refund Policy

Since our Service provides an immediate digital value delivery upon upgrade (unlimited AI script generation, YouTube parsing, etc.), all Pro subscription payments are generally non-refundable. Refund requests are subject to the terms and discretion of Lemon Squeezy.

4. User Account & API Key (BYOK) Responsibility

For advanced voice cloning features, the Service allows users to input their personal ElevenLabs API Key and Voice ID ("Bring Your Own Key" or "BYOK").

• You are solely responsible for the safety, security, and usage of your personal ElevenLabs API credentials.
• You are responsible for any charges incurred on your ElevenLabs account due to voice synthesis calls initiated through chickenspeaks.
• We store your API key credentials securely in your browser's local storage or salted server-side cache. However, you acknowledge the inherent security risks of storing API credentials.

5. AI Generated Content Disclaimer

The Service utilizes advanced Artificial Intelligence (LLM) models (e.g. Gemini, OpenAI) to generate language scripts and evaluate pronunciations. While we aim for natural conversational accuracy, we make no guarantees regarding the absolute factual correctness, translations, or cultural contextual accuracy of the generated scripts or AI feedback.

6. Service Availability & Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or free from errors.

In the event of database corruption, server downtime, Cloudflare network failures, API outages (OpenAI, Gemini, Deepgram), or software bugs, we are not responsible for any loss of training history, audio cache, saved phrase chunks, or any other user data. You acknowledge that you use the Service at your own risk.

7. Limitation of Liability & Maximum Compensation

In no event shall Black and Gold Feather Lab, its directors, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of your access to or use of the Service.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of these Terms or the use of the Service—whether in contract, tort, or otherwise—shall be strictly limited to the amount you actually paid to us for the Service during the one (1) month immediately preceding the event giving rise to the claim. If you have only used the Free tier, your sole remedy is to cease using the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
